

EXISTING ALERTON (ECC) OREGON CUSTOMERS
Environmental Controls Corp. is offering a service to assist and guide building owners through the BPS process. Environmental Controls Corp. has certified energy managers that will work with your firm to facilitate implementing the BPS required forms and the O&M and Energy Management plans.
THE OREGON BUILDING PERFORMANCE STANDARDS (BPS) HOUSE BILL 3409 (2023)
The BPS has hard dates assigned for compliance starting June 1, 2028.
There are “early adopters” incentives for owners that submit their forms starting July 1, 2026.
There are significant penalties for non-compliance.
FORMS:
• A: Application for BPS Compliance
• G: Grouped Buildings.
• X: Exempted Building.
• B: Building Activity and EUIt (target)
• If building doesn’t meet EUIt then Form A/G must be submitted by December 4, 2027 (180 days prior to June 1, 2028).
• This must include the following:
• O&M plan.
• Energy management plan (EMP)
• Form D (for Grouped Buildings)
• Can submit as early as July 1, 2026 for Early Adopter incentives.
• C: EUI calculation.
• D: Decarbonization plan.
• E: Energy Audit.
• L: Life cycle cost assessment.
In addition to the above services, for our customers with Alerton TUX DDC systems:
The TUX line of Alerton controls was initially offered in the early 1990s and discontinued in 2010. The communications protocol for these controllers is proprietary and the controllers are obsolete and no longer manufactured or supported.
These 30+ year old controllers continue to function as they were installed but we do receive calls to replace failed controllers on a regular basis. We strongly recommend that, in order to avoid untimely and disruptive HVAC control failures, customers upgrade their TUX systems with the new Ascent line of BacNet controls.
Environmental Controls Corp. understands that our customers are aware of the need to upgrade old technology with newer systems that feature enhanced usability, utilizing state-of-the-art technology and security. We also understand that many customers must weigh the need for upgrades with other pressing budgetary concerns. For that reason, we encourage our customers to engage with the Energy Trust of Oregon (ETO) and request a technical analysis study (TAS) of their facility to determine if there are monetary incentives available to offset the cost of the upgrade.
In our experience, we often see incentives in the range of 30-35% of the upgrade cost. This is in addition to the projected energy cost savings derived from Energy Efficiency Measures (EEM) recommended in the TAS. Additionally, the TAS will include a simple ROI calculation. Every building is different but the ROI regularly shows a 2-3 year payback after the incentive is included.

It follows then that we recommend the following steps:
• Initiate an energy audit with the ETO (Form 100e) for your facility.
• This is at no cost to the customer. The ETO hires the engineer directly.
• Important: This is a directed study specifically looking at upgrading the existing DDC system to generate energy savings.
• Environmental Controls can assist you in finding a qualified Energy Engineer to provide these specific studies.
• Environmental Controls Corp upgrade proposal will be incorporated into the TAS.
• TAS includes ROI calculation. (for financial decision makers).
Environmental Controls Corp. will provide a pricing proposal for the upgrade. This proposal will include:
• New BacNet field controllers.
• New BacNet area controller.
• New Compass server software (GUI) and workstation.
Added benefit of TAS:
• BPS EUI and EUIt are defined within the TAS.
• Eliminates the BPS requirement for an Energy Audit (Form E).
